A Federal High Court in Abuja, presided over by Justice Obiora Egwuatu has struck out a suit seeking the disqualification of Ademola Jackson Nurudeen Adeleke as the governorship candidate of the Peoples Democratic Party (PDP) in the July 26, 2022 election.
Reports received by our newsroom say that the suit was struck out on Thursday on the basis that the plaintiff had no locus standi to institute the case.
The plaintiff, Awoyemi Oluwatayo Lukman, filed charges against the Independent National Electoral Commission (INEC), the PDP and Adeleke.
Lukman prayed the court to render null and void the submission of Adeleke’s name to INEC on grounds of alleged unlawful action.
The position of the plaintiff was that Adeleke’s name was hurriedly submitted by PDP on March 11 as against between March 14 to 18 as contained in the INEC guidelines.
The plaintiff asked the court to declare the submission, illegal, unlawful, null, and void and be set aside because Adeleke’s name was not submitted within the period fixed by INEC,.
The plaintiff argued that the electoral body must be bound by its guidelines and going against it would be a violation of the provisions of the Electoral Act 2022.
In his judgment, Justice Obiora Egwuatu struck out the suit saying the said that Awoyemi Oluwatayo Lukman lacked locus standi to instituted the case.
