Funmi Falana, wife of human rights lawyer, Femi Falana (SAN) has protested the detention of a female soldier for her amorous relationship with a Youth Corper.
Mrs Falana wrote a letter to the Chief of Army Staff, Lt Gen Farouk Yahaya seeking the immediate release of the young military operative.
Private Sofiyat Akinlabi, a few days ago, accepted the marriage proposal of a male youth Corper in full public glare, right on the NYSC orientation camp ground.
Falana is contending that not only should Private Akinlabi be released, but her decision be respected in accordance with the freedom of association guaranteed by section 40 of the Nigerian Constitution, 1999.
The Army spokesperson, Brigadier General Onyema Nwachukwu had explained that the army took the decision to detain the soldier because her action violated extant military guidelines.
He said she got involved in a public display of “amorous” relationship with the trainee Corper.
On her part, Mrs Funmi Falana who is the Chairperson of Women Empowerment and Legal Aid (WELA) said the rule which bars women soldiers from contracting marriage in less than 3 years after enlistment does not apply to male personnel.
She cited the case of Women Empowerment and Legal Aid versus the Attorney General of the Federation 2015 1 NHRLR (PT 1) 57 in which the Federal High Court nullified Regulation 124 of the Nigerian Police.
Mrs Falana added that, “In view of the fact that male soldiers have not been penalised for involving themselves in amorous relationship in full military uniform, the threat to sanction Private Sofiyat Akinlabi is discriminatory.”
