South Africa Considers Legalising Woman Marrying Multiple Husbands

South Africa is considering legalising woman to get married to more than one husband at the time.

This is contained in a 67-page document issued by the Department of Home Affairs also called the Green Power on Marriage.

One sticking point in document is polyandry in the country. The department says it seeks to create a new marriage act that will allow anyone in the country to conclude recognised legal marriages.

Several kinds of marriages in South Africa not yet legal. This is complicated by the fact that marriage legalisation was deemed to not promote equality.

Among marriages not recognised by the country’s law are Hindu, Muslim, Jewish and Rastafarian. The Green Paper has therefore introduced a clause to recognise them.

Excerpt of the proposed marriage law:

“The failure to recognise these religious marriages is untenable and discriminatory. Moreover, activists submitted that equality demands that polyandry be legally recognised as a form of marriage”
