A Federal High Court on Wednesday, cleared former Finance Minister, Kemi Adeosun of the controversy regarding her participation in the NYSC scheme for which she carries a certificate.
In the judgement given by Justice Taiwo Taiwo, the court declared that Adeosun was not qualified to participate in the scheme when she graduated from the University of London at 22 years in view of the fact that she was a British citizen at that time.
Justice Taiwo added that at the time she formally returned to Nigeria and became a Nigerian citizen, she was over 30 years and was no longer eligible to participate in the Youth Service.
The judgement was delivered in suit number FHC/ABJ/CS303/21 brought by Wole Olanipekun on Adeosun’s behalf, Justice Taiwo of the Federal High Court, Abuja, held that the NYSC, certificate based on the constitution, is not a mandatory requirement for holding a political office in Nigeria.

The judgment also added that the plaintiff was not supposed to present herself for the NYSC scheme because under the 1979 constitution, which was in force at the time of her graduation, she was not a Nigerian citizen.
She applied for Nigerian citizenship after she retuned to the country at over the mandatory age of 30 years which was beyond the age of participation.
Justice Taiwo added that the extant Constitution did not recognise dual citizenships and therefore Kemi Adeosun could not have engaged in the NYSC scheme.
He added that she was also not required to present an NYSC certificate as a requirement to be appointed a Minister.
According to him, her ministerial appointment was, for that reason, not illegal neither was it unconstitutional even without presenting the certificate.
